Yesterday, the First DCA issued an opinion which provides guidance on the claimant’s burden of proof when seeking an advance on benefits. In Worthy v. Late last week, the Illinois Supreme Court issued an opinion favorable for employers on liability for spoliation of evidence in Martin v. Keeley & Sons, Inc., 2012 IL 113270. Businesses, and their insurance carriers, across Illinois have consistently been placed in difficult situations when it comes to the preservation of products, equipment, materials, and the like involved in work-place injuries. The First DCA issued an opinion this week pertaining to the availability of an apportionment defense when the claimant suffered prior work-related injuries which were never reported to the prior employer/carrier. We all know from the Pearson v. Paradise Ford decision that the 440.09(1)(b) major contributing cause defense does not apply to cases involving injuries combined from more than one work-related accident. View our newsletter here.

Florida officials are investigating a debt collection agency that agreed Monday to pay a $2.5 million civil settlement.

On January 11, 2012, OSHA Fort Lauderdale Area Director, Darlene Fossum, discussed OSHA initiatives for the coming year at the monthly meeting of the Association of General Contractors’ Safety Committee. Kelley Kronenberg partner Angelo M. Filippi received a summary judgment on behalf of his client in a Title VII case heard in Federal Court in Middle District of Florida. The Plaintiff filed his Complaint on August 12, 2010. The Complaint alleged violations of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e et seq. and the Florida Civil Rights Act of 1992, Florida Statutes § 760 et seq. The First DCA issued a decision yesterday in which every member of the Court had an opinion. Matrix Employee Leasing, Inc. v. Hadley was decided "en banc" by the entire Court, rather than by just three members of the Court, because two of the three original panel members desired to recede from a prior opinion of the Court on the same issue. To date, at least four JCCs have issued orders which allow a claimant to exercise their one-time change in a doctor by changing to another medical specialty. These orders are allowing for the change in specialty regardless of whether the employer/carrier timely authorizes a doctor within the same specialty as the original doctor. These orders are also allowing for the change in specialty without requiring a referral to that specialty. None of these orders have been challenged on appeal. View our newsletter here.
