Our attorneys have extensive experience in federal trial and appellate courts litigating employment discrimination, FMLA, ADA, and FLSA matters. This experience includes successfully defending employers in front of juries, as well as securing numerous summary judgment victories.  We also have successfully represented clients in numerous state court lawsuits concerning wrongful termination, covenants not-to-compete, breach of contract, invasion of privacy, defamation, intentional infliction of emotional distress, assault, battery, and Florida’s whistle blower statute.

In defending an employment discrimination case, we advocate being aggressive. The Employment Department’s counseling practice is designed to help clients understand their complex legal obligations in every employment area, and to comply with federal, state, and local laws prohibiting employment discrimination and retaliation. We frequently aid our clients in managing, disciplining and often terminating employees. Department attorneys also have extensive experience reviewing and drafting personnel policies and employee handbooks, drafting employment, non-solicitation and non-compete agreements, and educating clients with respect to compliance with state, federal, and local employment laws.

Our attorneys have handled litigation in the courts and before administrative agencies dealing with claims for unpaid minimum wage and overtime under the FLSA.  We also provide day-to-day advice concerning exemptions from overtime, travel time, vacation pay, and overtime policies.  We assist clients in conducting internal audits that are designed to catch potential problems before litigation erupts, and assist employers in dealing with administrative audits conducted by the Department of Labor.

The Firm advises clients concerning their affirmative action obligations under various federal laws and executive orders, including Executive Order 11246, Section 503 of the Rehabilitation Act of 1973, and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974.  Our attorneys also draft affirmative action plans, and represent clients in their dealings with the Department of Labor’s Office of Contract Compliance Programs.
