MSA Department
The Firm’s Medicare Set Aside Department ( MSA) handles all Medicare Secondary Payer requirements. The Department is comprised of experienced attorneys, paralegals, and Registered Nurse/Certified Medicare Set Aside Consultants (MSCC). The MSA Department is aware of all Medicare requirements and recent policy changes, and provides strategies to all our clients for managing workers' compensation claims in light of changes under the Medicare Secondary Payer Act and amendments.
Our focus is educating clients on Medicare requirements including up to date information on new law changes or policy requirements by Medicare; providing practice pointers to manage claims and ensure compliance with Medicare requirements including mandatory reporting requirements; identifying problems and solutions for better claims handling and impediments to settlement; and providing creative solutions to save threatened settlements.
Our unique position as defense counsel allows us to maintain continuity of the file and obtain the most conservative MSA Allocation while balancing CMS interests.
The MSA Department handles all aspects of the Medicare Set Aside process in Florida as well as on a National basis. Our services include, analysis and determination of Social Security Disability/Medicare status and need for CMS approval, preparation of MSA Allocations and submissions to CMS, conferencing with physicians to support MSA Allocation, drafting specially tailored MSA and complex annuity language for settlement agreements, analysis and assistance with professional custodial agreements, conditional payment verification and resolution, and monitor and alert clients of MSA law/policy changes affecting workers’ compensation settlements.
