Workers' Compensation

Kelley Kronenberg has one of the largest and most well known Workers’ Compensation defense departments in the state of Florida.  The Firm is a leader in the industry, having been established in 1980 and maintaining a presence in the ever-changing industry since then.  Our experience and stability serve the base of our Firm’s success.  We are an AV-rated firm by Martindale-Hubbell and many of the attorneys are individually AV-rated. 

The Workers’ Compensation Department routinely suggests to clients and thereby schedules specific settlement days. The Firm places great emphasis on speedy and efficient settlements of files along with adjuster interaction and employer interaction. 

The Firm schedules visits to employers at most employer sites to examine an accident location or machinery or simply to observe the work place environment for a better understanding of our clients and the claim, as applicable.  

We conduct routine file reviews with the employer to promote shared information so that the employer’s concerns are being heard and taken into consideration.  Employers are encouraged to attend depositions and mediations to fully participate in the defense of the claim.

We continually communicate the nature and the implications of the development of their cases. 

Planning conferences between claims professionals and the attorneys are stressed to identify specific issues, develop a plan of action, and create a prompt and fair resolution to the litigated matter.  Target dates are agreed upon and established and these goals are indicated to all members of the team handling the file.  All of these aspects go toward creating the best opportunity for an early resolution, efficient legal representation and interaction.  We promote continuous communications on the files obtaining proper settlement authority with the claims adjuster and discouraging unnecessary copying, messengers and other types of costs unless specifically requested by the claims adjuster.  We routinely consult regarding motion creation in our routine re-strategy of the file handling and promote the communication of all relevant information on a regular basis via letters and e-mails, per the client’s specifications. 

The Workers’ Compensation Department is increasingly active in the Legislature and was involved in the completion of the reformation of the Workers’ Compensation Law in 2003.
