Coverage B

Kelley Kronenberg’s Liability Department works with employers and carriers to identify, investigate and defend Coverage B/Employer liability claims under the Workers’ Compensation Act.  We assist the employer and carrier in all aspects of the Coverage B process.  This includes preservation of the accident scene to shield the employer from spoiliation of evidence claims; responding to OSHA investigations which may create employer liability; and aggressively asserting workers' compensation immunity throughout the pre-litigation and litigation process.  We also have extensive knowledge defending employers and carriers in personal injury claims which occur on construction sites.  These claims are unique because they require application of the "Statutory Employer" doctrine which grants workers' compensation immunity to all contractors and subcontractors.
