Kelley Kronenberg Attorney Kaitlin Coyle recently secured summary judgment in Miami-Dade County, successfully defending a major retailer in a premises liability case with significant exposure.
The plaintiff filed suit against the firm’s client following a trip and fall incident allegedly caused by uneven pavement outside a retail location. Despite retaining a professional engineer who claimed the pavement violated building codes and created a trip hazard, the plaintiff’s case faced a significant legal hurdle.
Drawing on premises liability precedent, Kaitlin demonstrated that the alleged hazard was open and obvious, and not inherently dangerous. Through strategic motion practice, she successfully argued these key points before Judge Vivianne Del Rio in the Eleventh Judicial Circuit.
After reviewing the defense’s motion for summary judgment and hearing legal arguments, the Court found the condition was open and obvious as a matter of law. Judge Del Rio granted the motion, resulting in a dismissal with prejudice.
