ShareKelley Kronenberg Negotiates Nominal Settlement in Hurricane Irma Case
Kelley Kronenberg Partner Alan Swindoll, alongside Partner and Business Unit Leader, Charles Prior, spearheaded a notable victory for our insurance company client through skillful negotiation tactics.
The first-party property case centered on a Hurricane Irma claim initially denied due to late reporting. The plaintiff pursued legal action for Breach of Contract, seeking damages exceeding $50,000.00.
Our team argued that the prolonged duration between the loss event and its reporting prejudiced the defendant, impeding a thorough investigation into the claim’s causation and damage assessment.
Through strategic advocacy, our team facilitated a settlement for a nominal sum, representing merely 2.5% of the overall estimated exposure. Furthermore, the plaintiff voluntarily dismissed the claim with prejudice.
