ShareKelley Kronenberg Secures Dismissal in $150,000 Hurricane Ian Insurance Claim
Kelley Kronenberg Partner Melissa Usher secured a significant victory in a Hurricane Ian insurance claim case, resulting in a voluntary dismissal with prejudice by the plaintiffs.
The case involved a Hurricane Ian damage claim reported on August 30, 2023, with damages sought in excess of $150,000.00. Through diligent investigation and strategic legal maneuvering, Melissa uncovered crucial information that turned the tide of the case.
Discovery revealed an undisclosed prior Hurricane Irma claim where the plaintiffs had received payment for a full roof replacement but never completed the work. This discovery led Melissa to add an Affirmative Defense for misrepresentation. Subsequently, the plaintiffs’ deposition revealed contradictory testimony regarding previous roof claims.
Faced with the threat of a misrepresentation defense and potential summary judgment, the plaintiffs filed a Notice of Voluntary Dismissal with Prejudice, effectively ending the case in favor of the defendant.
