Kelley Kronenberg Secures Full Defense Verdict for Anchor Property & Casualty Insurance Company

Kelley Kronenberg’s First-Party Property Insurance Defense Team, led by Jeffrey Wank (Chair of First-Party Property), Derek Goldsmith (Partner/Business Unit Leader), and Jazlyn Juda Ouimet (Practice Partner), achieved a resounding victory for our client, Anchor Property & Casualty Insurance Company, in a recent jury trial held in Florida’s 18th Judicial Circuit in Brevard County.

The case, presided over by Judge Curt Jacobus, centered around a plaintiff’s claim for damages following a hailstorm in March 2019. The plaintiff sought full metal roof replacement and repairs to their garage door, A/C unit, and screen enclosure, presenting a total estimated exposure of approximately $225,000.00. After a thorough claim investigation, Anchor determined that the estimated damages fell below the policy deductible.

During the course of litigation, the plaintiff also presented an estimate for over $100,000.00 for interior damages. Kelley Kronenberg’s trial team was able to exclude the claim for interior damages prior to trial.

At trial, Kelley Kronenberg’s trial team presented compelling evidence to support Anchor’s position that the roof did not require replacement due to the reported hailstorm. The plaintiff presented evidence from a meteorologist and expert contractor in support of his claim to replace the roof. The jury carefully considered the evidence and ultimately agreed with Anchor’s claim investigation. After only deliberating for just over 30 minutes, the jury returned a complete defense verdict in favor of our client.  pl

This victory reinforces our firm’s position as a leader in the insurance defense industry, and we look forward to continuing to deliver excellent results for our valued clients. View the Final Judgment for the Defense here: https://www.kelleykronenberg.com/wp-content/uploads/2024/06/Order-Final-Judgment-for-Defendant.pdf
