ShareKelley Kronenberg Secures Major Victory in $1M Motocross Industry Liability Case
Kelley Kronenberg Partner/Business Unit Leader Matthew Garnett and Attorney Christopher Wright secured a favorable settlement in a potentially industry-impacting liability case before Judge Janesk in Putnam County, Florida. Mr. Garnett, serving as first chair, successfully resolved the matter for less than 2% of the potential $1 million exposure.
The case involved a liability claim against our client, the owner of commercial land that has been used for various off-road sporting events for decades. Since the claim was venued in Putnam County, it was subject to an accelerated docket.
Matthew and Christopher identified multiple legal deficiencies in the plaintiff’s case, and in addition, with respect to the merits of the action, also secured key out-of-state witness affidavit testimony. The team developed compelling summary judgment arguments while simultaneously protecting related motorcross entities from suit that were not named in the original complaint.
Neither our client nor its vendors were subject to a single deposition in the lawsuit. In addition, our client avoided a costly work-up of medical damages as well as retainer of both standard-of-care and medical experts. Instead, Matthew worked professionally with counsel for the plaintiff to speed the matter towards resolution. Our team’s proactive approach and strategic communications saved substantial litigation costs while protecting our client’s interests.
