ShareKelley Kronenberg Secures Summary Judgment in Long-Contested Foreclosure Case
In a significant win for mortgage lenders, Kelley Kronenberg Attorney Danielle Spradley successfully obtained a summary judgment in a highly contested foreclosure matter initiated in June 2014 and litigated for nearly 11 years, resulting in a judgment of approximately $280,000.00.
The case, heard in Florida’s 4th Judicial Circuit, involved a property where the borrower had defaulted on the note by failing to make the payment due on December 1, 2009. Despite multiple legal challenges from the pro se borrower, including an appeal of an earlier judgment based on service issues and the assertion of six separate affirmative defenses (legally insufficient lis pendens, lack of standing, failure to state a claim, insufficiency of complaint, no chain of title, and violations of equal protections), Danielle effectively demonstrated the lender’s standing to foreclose.
The Court found in favor of the lender on all counts, granting the Motion for Summary Judgment, reestablishing the lost note, and reforming the mortgage. The final judgment for the full amount was entered on March 5, 2025, with the foreclosure sale scheduled for June 3, 2025.
This victory highlights Kelley Kronenberg’s ability to navigate complex foreclosure litigation, even in cases with significant procedural history and borrower opposition and underscores the firm’s commitment to achieving favorable outcomes for financial institution clients.
