ShareKelley Kronenberg’s Swift Defense Defeats $1.5M Slip and Fall Claim
Kelley Kronenberg Partner/Business Unit Leader Paul Milberg and Attorney Benjamin Lazarus, with invaluable support from Legal Assistant Lisa Mananzan, secured summary judgment in Pinellas County Circuit Court, successfully defending a condominium association against a premises liability claim with potential exposure exceeding $1.5 million.
The case arose from an alleged slip and fall incident in a stairwell. Despite significant claimed damages, substantial medical bills, and an unfavorable medical examination, our team demonstrated that no evidence existed to establish the presence of a dangerous condition or the defendant’s notice of any hazard.
Paul successfully argued the motion for summary judgment before Judge Amy Williams, while Benjamin crafted the compelling legal arguments that highlighted the plaintiff’s inability to meet their burden of proof on liability. The team’s focused strategy emphasized the lack of evidence regarding both the alleged dangerous condition and any actual or constructive notice.
The Court agreed with the defense’s position, granting summary judgment and protecting the client from substantial exposure while avoiding costly litigation.
