ShareCLIENT ALERT: Florida’s Minimum Wage Change Effective September 30, 2024
The Florida minimum wage will increase by one dollar ($1.00) to $13.00 per hour, effective September 30, 2024. Additionally, the minimum wage for employees where the employer takes the tip credit will increase to $9.98.
The Florida minimum wage will continue to increase by $1.00 every September 30 until 2026, at which point it will reach $15.00. After reaching $15.00, the minimum wage will be adjusted annually based on inflation.
For those employees where the employer takes the Tip Credit, tipped employees’ hourly wage rate will also continue to increase by $1.00 every year until 2026 as follows:
- $9.98 on September 30, 2024
- $10.98 on September 30, 2025
- $11.98 on September 30, 2026
Florida employers are required to post the new minimum wage at their place of business, which must be visible to employees. Copies of the poster can be found here.
Employers must also ensure that the new minimum wage is accurately reflected in the paychecks of both non-tipped and tipped employees. An employer may be subject to strict penalties if it does not comply with the applicable minimum wage rate effective September 30, 2024.
EMPLOYER ACTION ITEMS
- Review current payroll systems for Florida-based employees to ensure they are being paid at least the new minimum wage starting September 30, 2024.
- Ensure the new Florida Posters with the new minimum wage are properly posted on October 1, 2024.
- To the extent you are taking a tip credit toward the minimum wage, it is recommended that you document the Tip Notices required by the federal Fair Labor Standards Act and explain to your tipped employees how payroll is calculated.
