Pre and Post Nuptial Agreements

Overview

Before marriage, many couples desire an arrangement to be in place for addressing financial issues in the event of separation, divorce, or death. Under Florida law, this can be accomplished through a premarital agreement, also known as an antenuptial or prenuptial agreement. Similarly, married couples who wish to engage in planning for a divorce can do so through a postnuptial agreement and address all of their issues before either of them files a petition for dissolution of marriage or even while their marriage remains stable.

Regardless of the type of agreement, the agreement must be drafted properly so that it is enforceable in court.
