Conflicts of Interest

Overview

When appointing a Personal Representative or trustee, there are circumstances in which the desired appointee has a conflict of interest concerning the instrument. For example, they can be a beneficiary but also be required as PR/trustee to act in the best interest of the estate/trust. In these situations, other people may be appointed as PR/trustee instead.  Oftentimes, a conflict of interest can be resolved with a waiver of conflict of interest, but not always.
