Improper Administration and Distributions

Improper Administration and Distributions

Overview

Sometimes if an estate/trust isn’t administered properly, an involved party is doing something improper, or an interested party is keeping assets for themselves, an attorney is needed to remedy the situation. In some instances, distributions are made to people who are impermissible beneficiaries under a trust. Also, beneficiaries can get the wrong assets/property, contrary to what the instrument gifted them. Finally, there are circumstances where a trustee refuses to make distributions.
