FORT LAUDERDALE, Fla.— Earlier this year, Kelley Kronenberg attended the 17th Annual Windstorm Insurance (WIND) Conference at the Hilton Bonnet Creek in Orlando, FL, where Tanaz Salehi, Partner in the firm’s Miami office, delivered the “Hijacked Claims or Distorted Interpretations?” seminar with a panel of speakers that included Robin Benjamin, Esq. Of Counsel, and Jason Scarberry, Esq.
The presentation provided detailed information regarding the breakdown of Appellate rulings in Florida, including real world consequences of the court holdings. The panel also discussed the history of Assignment of Benefits in contract law, how it has been used historically to assign insurance claims and benefits, and court rulings as it related to requirements of a valid post-loss assignment of benefits. Additionally, the panel reviewed the steps that law firms, insurance companies, and restoration companies need to take in understanding the legal landscape of assignment of benefits, as well as their rights and duties as it relates to property claims.
The annual WIND Conference provides a forum for review and discussion of windstorm and related property insurance issues. It is the only conference of its kind focusing solely on windstorm claim issues and is geared to many different levels and professions in the industry. Representatives from all segments of the windstorm insurance claims industry convene for the three-day event to address the impact of past hurricane seasons and important windstorm insurance issues.
