Kelley Kronenberg Partner Kathrine Conroy secured a favorable mediation resolution on behalf of the insurer in a disputed storm damage claim filed in Lake County, resolving the matter within nine months of service and delivering nearly $75,000.00 in savings against the plaintiff’s highest demand. 

The claim arose when an unpermitted metal porch roof installed by the homeowners became dislodged during a storm and caused damage to three shingles and interior areas of the property. The insurer opened coverage and paid for the covered damages at the time of the claim. The plaintiffs, however, submitted escalating contractor estimates beginning at approximately $35,000.00 and ultimately reaching over $90,000.00, seeking full roof replacement and extensive interior repairs. They filed suit based on the higher estimate. 

Kathrine pursued an aggressive defense strategy from the outset, including written discovery, depositions, and the retention of a dually licensed general contractor and professional engineer whose findings supported both the defense position and a potential motion for summary judgment. The expert concluded the roof was repairable rather than in need of full replacement, and Kathrine held firm to that position throughout the litigation. 

At mediation, Kathrine maintained a hard line consistent with the expert’s repair estimate rather than capitulating to the plaintiffs’ demand for full replacement. The case resolved for a fraction of the plaintiffs’ highest demand, representing a savings of more than 80% against what the plaintiffs sought, and closed well within the first year of litigation.
