Kelley Kronenberg Attorney Samantha Navedo Obtains Two Non-Binding Arbitration Awards

Kelley Kronenberg’s Samantha A. Navedo successfully obtained two non-binding arbitration awards on behalf of the insurance carrier, finding the Plaintiff was entitled to $0.00! Both cases concerned late reported Hurricane Irma claims.

 

In the first case, the carrier stood by their initial below deductible decision ($735.11 covered damage). Plaintiff provided their estimate ($114,665.69) and expert report at arbitration. However, the arbitrator agreed with the carrier’s expert findings regarding the cause and origin of the water intrusion. Ultimately, the arbitrator found that the Plaintiff was not entitled to additional damages.

 

In the second case, the carrier denied the claim, citing the statute of limitations and prejudice due to late reporting. The court-appointed arbitrator agreed that the Plaintiff failed to provide prompt notice of the loss. Additionally, the arbitrator found that the Plaintiff’s engineer report could not be relied on to determine the cause of damages because the roof was in the process of being replaced when they inspected the subject property. The arbitrator further noted that the Plaintiff’s report was vague and did not provide sufficient evidence or explanation to support its conclusions.
