Kelley Kronenberg Prevails on Motion for Fees and Costs After Plaintiffs Fail to Appear for Deposition

Kelley Kronenberg Attorney, Jennifer Orcutt-Angius, recently won a Motion for Fees and Costs based on Florida Rule of Civil Procedure 1.380(d) which states that if a party fails to attend their deposition or response to a request, the other party can request expenses, including attorney’s fees.  

After Plaintiffs’ failed to attend their depositions, Jennifer filed the Motion for Fees and Costs asserting our client’s entitlement to same. The judge granted the motion, ruling Plaintiffs were responsible for the failure to attend the deposition that Defendant is entitled to attorney’s fees and costs. The Court provided the parties’ respective counsel the opportunity to reach an agreement regarding the amount of fees and costs owed, reserving jurisdiction in the event an agreement cannot be reached.
