Kelley Kronenberg Secures Dismissal in $150,000 Wind/Hail Damage Claim

Kelley Kronenberg Partner Luke Sharkey, representing Citizens Insurance Company, achieved a significant victory in a complex wind/hail damage case. The dispute, set for trial in Florida’s 15th Judicial Circuit, Palm Beach County, ended with the plaintiffs agreeing to dismiss their $150,000.00 claim with prejudice. 

The case stemmed from an alleged January 2022 wind/hail event, with the plaintiffs seeking full tile roof replacement and exterior repairs. Luke’s assertive defense strategy highlighted wear and tear as the primary cause of damage, countering the plaintiff’s claims of storm-related issues. 

A critical element in this case was the plaintiffs’ engineer report, which surprisingly cited a different loss date than claimed. This discrepancy, unnoticed by the plaintiff’s counsel throughout litigation, significantly weakened their position. 

Faced with Luke’s well-prepared defense and the looming trial date, the plaintiffs agreed to dismiss the case, with Citizens only responsible for its own legal fees.
