Kelley Kronenberg Secures Favorable Ruling in Strict Statutory Adherence Case

Kelley Kronenberg Partner, Glenn Dill, achieved a significant victory in a recent case involving an assignment of benefits (AOB) for mitigation services on a first-party property loss. The focal point of the dispute was the validity of the AOB, which had been rejected by the insurance carrier due to non-compliance with Florida Statute 627.7152(2)(a). The AOB lacked essential information specified in the statute, particularly 627.7152(2)(a)(2). 

While the plaintiff argued “substantial compliance,” Glenn effectively advocated for a strict interpretation of the statute, emphasizing the importance of adhering to its provisions. Ultimately, the Court ruled in favor of our client, highlighting the necessity for precise adherence to statutory requirements. 

Notably, while plaintiff’s initial invoice was $2099.00, Glenn’s successful defense averted significant potential attorney’s fees and costs. 

Despite encountering initial reservations from the Court, the dedicated efforts of Aeriel Porter and the unwavering determination exhibited by Citizens management were integral factors in attaining this favorable resolution.
