Kelley Kronenberg Successfully Challenges Expert Testimony, Secures Victory for Citizens Insurance

Kelley Kronenberg Partner Danielle Wallis, a distinguished member of our firm’s First-Party Property and Coverage Division, recently secured a significant victory representing Citizens Insurance in a pivotal case before Miami-Dade’s Judge Echarte.  

In this case, the defendant argued that the plaintiff’s expert, Grant Renne, should be precluded from offering testimony on cause, origin, and duration related to a Tropical Storm Eta claim. Judge Echarte ruled in favor of the defendant, stating that Renne’s opinion lacked sufficient factual basis, reliable principles, or methods. The Court determined that Renne’s assessment was grounded on inaccurate calculations of wind loads and an insufficient review of dated photographs, rendering his testimony as nothing more than pure opinion without substantiation. 

The plaintiff had sued for breach of insurance contract, seeking benefits totaling $75,000.00, with exposure exceeding $100,000.00. However, the Court’s order unequivocally granted the defendant’s Daubert Motion to Exclude Evidence and Testimony from Renne, effectively barring his testimony on causation.
