ShareKelley Kronenberg Turns $134,000 Hurricane Claim into $5,000 Settlement
Kelley Kronenberg Practice Partner Esmee Vera-Benavidez secured a remarkable victory for our insurance company client in a complex hurricane damage case. What began as approximately $134,000.00 in exposure was skillfully negotiated down to a mere $5,000.00 settlement.
The case, stemming from a September 2020 hurricane claim, faced multiple procedural hurdles. After an initial dismissal and the plaintiff’s failure to timely amend, Esmee capitalized on the plaintiff’s procedural missteps, including delayed service and a deficient complaint.
Armed with a potent motion to dismiss and alternative motion for summary judgment, Esmee’s strategic approach put immense pressure on the opposing counsel. Just 30 minutes before the scheduled hearing, faced with the strength of our legal arguments, the plaintiff agreed to settle for less than 4% of the initial claim value.
This outcome highlights Kelley Kronenberg’s commitment to aggressive defense and strategic negotiation. Our team’s thorough case analysis and preparedness often lead opponents to reconsider their position when confronted with our formidable litigation tactics.
