In this case, the insureds initially filed a breach of contract lawsuit, seeking damages exceeding $187,000 for alleged hurricane damage to their Broward County home. TypTap investigated and denied the claim and then promptly retained Kelley Kronenberg to defend their interests. 

Jake and Zachary swiftly developed an aggressive defense strategy, filing a comprehensive Answer and Affirmative Defenses and initiating discovery. Jake’s thorough deposition of the insured husband proved pivotal, after which the plaintiffs ceased participating in the lawsuit. 

Leveraging the plaintiffs’ non-compliance, our team filed multiple motions to compel and for sanctions. Their persistence paid off when the Court granted entitlement to monetary sanctions against the plaintiff. 

Faced with Kelley Kronenberg’s relentless pursuit and the court-ordered sanctions, the plaintiffs agreed to dismiss the case with prejudice. TypTap paid nothing in damages, completely averting the potential $187,460.27 exposure.
