Kelley Kronenberg First Party Property Team Secures 98.5% Reduction in Complex Insurance Dispute

Kelley Kronenberg’s First Party Property Team, led by Senior Trial Counsel Ryan Galka and Partner Glenn Dill, recently secured a significant victory for a major insurance company client. The team successfully resolved a complex breach of contract dispute through mediation, avoiding protracted litigation in the Broward County Circuit Court. 

The case involved two separate claims related to alleged property damage. The first claim was for cast iron pipe loss, while the second was for a master bathroom supply line leak. Both claims were full denials. The Complaint in this action sought damages of nearly $350,000.00.  

Our team’s thorough investigation and strategic planning were crucial in addressing the complex issues at hand. They asserted strong defenses, including the absence of actual direct physical loss, constant and repeated seepage and leakage, and the insured’s failure to comply with duties after loss.   

Confronted with our team’s formidable defense strategy, the plaintiffs opted for settlement over trial. Ryan and Glenn’s skillful negotiation resulted in a remarkable outcome: a settlement of merely 1.5% of the initial damages sought. This resolution not only safeguarded our client’s interests but also exemplified the effectiveness of our strategic approach in navigating complex insurance disputes.
